Italy's original 1912 citizenship law transmitted citizenship almost exclusively through fathers. A child born to an Italian mother and foreign father did not acquire citizenship under that law's literal text.
Constitutional Court Rulings No. 87/1975 and No. 30/1983 struck down this exclusion as unconstitutional gender discrimination, effective retroactively from the entry into force of the Italian Constitution on January 1, 1948.
Because Italian Consulates apply administrative rules strictly as written, the Supreme Court of Cassation (Joint Session Ruling No. 4466/2009) established that Italian Judicial Courts have exclusive authority to recognize maternal line citizenship claims for children born prior to January 1, 1948, applying constitutional gender equality retroactively to pre-1948 births.
