Judgment No. 63/2026: What the Constitutional Court States
Constitutional Court Judgment No. 63/2026, published on April 30, 2026, represents a significant milestone in the legal landscape of citizenship jure sanguinis. The Court upheld the constitutional legitimacy of Law 74/2025, dismissing the questions raised by the Ordinary Court of Turin concerning the alleged violation of Articles 3, 22, and 117 of the Constitution.
However, the Court left several crucial questions open. In particular, it did not resolve the issue of protecting the legitimate expectations of applicants who took formal steps prior to the reform’s entry into force. This question has now been deferred to the United Sections of the Court of Cassation, which are tasked with delivering definitive guidance.
